Got an H-2B Notice of Deficiency? Respond with the record you will need on appeal
An H-2B Notice of Deficiency response is due within 10 business days, and it becomes the record BALCA will review. We build responses like briefs: every fact tied to evidence, every legal error corrected, every request answered.
- Temporary need, number of workers and job order deficiencies
- Household cases: school-entry, medical and au pair issues
- USCIS RFEs on VIBE verification and the three-year limit
- Partial certification requests and BALCA administrative review
How we prepare an H-2B Notice of Deficiency response
Day 1: triage
We calendar the deadline, separate technical cures from arguments, and send you a precise list of documents and declarations.
Days 2 to 8: build
Payroll converted to headcount, third-party seasonal data, sworn declarations, and the BALCA decisions that control your issue.
Days 9 to 10: file
A conformed job order, a cross-reference table answering every item DOL requested, and a response that preserves your appeal.
Why the H-2B Notice of Deficiency response matters so much
BALCA reviews only the record that was before the Certifying Officer, and it will not consider evidence offered for the first time on appeal. If a document does not exist, the response must say so and explain why. In the 2026 season, most business denials accepted the season but rejected the number of workers, so the math has to be in the response itself.

Frequently asked questions
How long do I have to respond to an H-2B Notice of Deficiency?
Ten business days from the date of the notice. Without a timely response, DOL denies the application.
Can you take over a case another firm or I filed?
Yes. We can enter as counsel and prepare the response, as long as there is time to gather the evidence. Contact us the day the NOD arrives.
What if my application was already denied?
You may request administrative review by BALCA within 10 business days, or refile a corrected application. We will tell you which is faster and stronger for your facts.
Do you handle USCIS requests for evidence too?
Yes, including VIBE employer-verification RFEs, maximum-period-of-stay RFEs and signature issues.
