In-home care for the person you love, built on a case DOL will certify
An H-2B caregiver visa can bring a home health or personal care aide into your home for a medically defined period. We turn your physician’s prognosis into a temporary need the Department of Labor will accept.
- Care for an aging parent or a family member with a serious condition
- Physician-supported end dates and two-caregiver shift structures
- Self-directed, trust-funded and family-funded care arrangements
- Notice of Deficiency responses grounded in BALCA caregiver decisions
What makes an H-2B caregiver visa case succeed
A specific prognosis
A specialist’s letter with a concrete timeline. BALCA reversed a denial when the physician gave a one-to-three-year prognosis, and affirmed one when the doctor called it “uncertain.”
A definable transition
An end date tied to a move to skilled nursing or specialized care, ideally with a margin below three years so it is plainly driven by medicine.
Staffing the medicine supports
Often two caregivers on day and night shifts, backed by an hour-by-hour coverage plan that matches the physician’s letter.
How the H-2B caregiver visa works
Caregiver cases are filed as one-time occurrences. The challenge is that a progressive condition can look permanent. The answer is to separate the need for care, which may continue, from the need for these H-2B caregivers, which ends at a medically definable transition. Our approach draws on Helping Hands of North Carolina, LLC, 2024-TLN-00066, where the Board reversed a denial and held that a Certifying Officer may not substitute personal judgment for the physician’s prognosis.

Frequently asked questions
Can I sponsor a caregiver for my parent on an H-2B visa?
Yes, when a physician can document the care need and a definable transition that ends it, such as a move to facility care. The household or care recipient acts as the employer.
What occupation is used for an H-2B caregiver?
Usually home health aide (SOC 31-1121) or personal care aide (31-1122), depending on the duties. The job description must match the care plan.
How many caregivers can we request?
As many as the medical evidence supports. Many cases request two caregivers on shifts. The physician letter and the application must say the same thing.
What if DOL says the need is permanent?
That is the most common objection. We answer it with the prognosis, the staging literature and the controlling BALCA decisions within the 10-business-day deadline.
