Hire the nanny your family needs, lawfully and for the long run
Our H-2B nanny visa lawyers have built household H-2B cases since 2017. We prove a temporary need DOL will accept, set an end date the facts support, and prepare your nanny for the consular interview.
- One-time occurrence cases with school-entry end dates
- Au pair families moving to a professional, full-time nanny
- Household employer setup: FEIN, state registration, payroll
- Deficiency notices answered with the BALCA decisions that control
How an H-2B nanny visa lawyer builds your case
Prove the need
We document why your family needs full-time care now and why that need ends on a definable date, usually your youngest child’s full-day school eligibility.
Get the details right
Identical duties, hours and lodging terms across the wage request, the ETA-9142B and the job order, so DOL has nothing to flag.
Carry it to the visa
USCIS petition, VIBE verification for households, and a short consular-facing contract that will not trigger a 214(b) refusal.
Why families hire an H-2B nanny visa lawyer
Household H-2B cases are judged by the same rules as resort and landscaping cases, but they turn on different facts. The end date must come from your family’s circumstances, never from the three-year maximum. Prior au pairs must be explained carefully, because BALCA has treated a series of au pairs as proof of an ongoing need. And USCIS often cannot verify a private household, so the petition needs an FEIN notice and payroll evidence ready to go.

Frequently asked questions
Can a family really sponsor a nanny on an H-2B visa?
Yes. A household can be the H-2B employer, usually under the one-time occurrence standard, with an end date tied to a definable event such as the youngest child’s full-day school eligibility.
How long can an H-2B nanny stay?
For the certified period, which cannot exceed three years for a one-time occurrence. In practice, approvals are often issued 12 months at a time.
We have an au pair now. Does that hurt our case?
Not necessarily, but it must be explained. An au pair is not a household employee, yet DOL may read a series of au pairs as an ongoing need. We address that history directly.
When should we start?
Now, if you want a nanny for April 1, 2027. The prevailing wage request comes first, and the January filing window does not move. October 1 starts are filed in early July.
